Communications Taxes

Under legislation enacted by the 2006 General Assembly, House Bill 568, the new Virginia communications sales and use tax, also referred to as the communications sales tax, will replace most of the current state and local taxes and fees on communications services, effective January 1, 2007. The new communications sales tax, which is imposed on the charge for or sale of communications services at the rate of 5%, will generally be collected from consumers by their service providers and remitted to the Department of Taxation each month, beginning with the month of January 2007. In cases where a consumer purchases taxable communications services and no tax is collected from the consumer on the purchase by the service provider, the consumer will be responsible for paying a communications use tax.

Also, a uniform statewide E-911 tax of $0.75 per line will replace the local E-911 taxes currently imposed for landline telephone service.

911 Emergency Telephone System Tax

Section 58.1-3813 of the Code of Virginia allows any city, county, or town that has established or will establish an enhanced 911 emergency telephone system to impose a special local tax on the consumer of telephone services. The tax cannot be imposed on federal, state, or local government agencies. Any tax imposed under this section shall be used solely to pay for reasonable, direct recurring and nonrecurring capital costs, and operating expenses incurred by a public safety answering point in designing, upgrading, leasing, purchasing, programming, installing, testing, administering, delivering, or maintaining all necessary data, hardware and software required to receive and process emergency telephone calls through an E-911 system, including salaries and fringe benefits of dispatchers and direct call-takers of an E-911 system and costs incurred in training dispatchers and direct call-takers in receiving and dispatching emergency telephone calls, and the salary and fringe benefits of the public safety answering point director or coordinator so long as such person has no other duties other than the responsibility for the public safety answering point.

 

Table 14.1 provides the year 2003 special tax rates for enhanced 911 emergency telephone services for the 39 cities, 90 counties, and 22 towns that report imposing this tax. The tax ranges from $0.26 per month to $3.00 per month.
